Employee Assistance Programme

It is becoming increasingly common for employers to provide staff with access to advisory services to help them deal with issues outside the workplace. The Employee Assistance Programme (EAP) provides a number of telephone helplines and counselling services to employees on a wide range of issues including stress, debts, legal problems (excluding against the company), health worries and family-related problems. This benefit will typically be added to a Group Life Assurance or Group Income Protection scheme.

An EAP offers enormous value to the company in protecting against employees claiming compensation for stress-related illness. In a recent Court of Appeal ruling, Lady Justice Hale made the judgement that “any employer who offers a confidential counselling service with access to treatment is unlikely to be found in breach of duty [of care].”
